Terms of Use
Effective date: {EFFECTIVE DATE — e.g. January 1, 2026}
These Terms of Use govern your access to and use of https://flowerscapitals.com (the “Site”), operated by FlowersCapital, LLC. By using the Site, you agree to these terms. If you do not agree, please do not use the Site.
What this site is
The Site provides information about our home-buying services and lets you request a cash offer on a property or join our list of prospective buyers. It is informational and does not constitute an offer to purchase any property, a solicitation of an offer to sell, or a guarantee that we will purchase your property.
We are not real estate agents or brokers
FlowersCapital, LLC is a real estate investment company. We are not licensed real estate agents or brokers, we are not acting as your agent or fiduciary, and we do not represent you in any transaction. When we discuss purchasing your property, we are acting as a principal — the buyer — on the opposite side of the transaction from you.
We may resell a property we purchase, or assign our rights under a purchase contract to a third party, for a profit that may be substantial. Any price we offer reflects our business judgment about what the property is worth to us given its condition, the cost of repairs, our holding and transaction costs, and the risk we take on. It is not an appraisal, a broker price opinion, or a statement of fair market value.
{STATE-SPECIFIC WHOLESALING DISCLOSURE. An increasing number of states regulate wholesale real estate transactions directly, and requirements change often. Have counsel confirm the exact disclosure language, licensing, and registration requirements that apply to wholesaling in Michigan, and insert what is required here.}
No professional advice
Nothing on this Site is legal, tax, financial, or real estate advice. Information about probate, foreclosure, liens, taxes, and closing processes is general and may not reflect current law or your specific circumstances. You should consult your own attorney, accountant, or licensed real estate professional before making any decision about your property.
Submitting information to us
When you submit a form, you represent that the information you provide is accurate, that you are at least 18 years old, and that you are the owner of the property or are authorized to act on the owner’s behalf.
You also agree to receive calls and text messages, including automated messages, about your property at the number provided. Consent is not a condition of any purchase. Message and data rates may apply. You can reply STOP at any time to opt out. See our Privacy Policy for details on how we handle your information.
Submitting a form does not create a contract, an obligation for us to make an offer, or an obligation for you to accept one. No agreement to buy or sell exists until both parties sign a written purchase agreement.
Acceptable use
You agree not to use the Site to submit false or fraudulent information, to submit information about a property you have no authority over, to scrape or harvest data, to attempt to interfere with the Site’s operation, or for any unlawful purpose.
Intellectual property
The content on this Site — text, design, graphics, and code — is owned by FlowersCapital, LLC and protected by copyright and other laws. You may not reproduce or distribute it without our written permission.
Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that its content is accurate, complete, or current.
Limitation of liability
To the fullest extent permitted by law, FlowersCapital, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. {COUNSEL: consider whether to include a liability cap, and confirm enforceability in each state.}
Governing law and disputes
These terms are governed by the laws of the State of {YOUR STATE OF FORMATION}, without regard to its conflict of laws rules. {COUNSEL: decide whether to include an arbitration clause and class-action waiver, and specify venue. This choice has real consequences and should not be left as boilerplate.}
Changes to these terms
We may update these terms at any time. Changes take effect when posted, and your continued use of the Site means you accept them.
